On October 8, 2012 I was traveling with my daughter to my two year olds nephews funeral. When I woke up that morning I wasn't feeling well but I could only think it was due to the loss of a loved one. I had been up throughout the night crying and trying to prepare myself for the funeral. As I was getting dressed that morning I felt faint so I grabbed a quick bite to eat hoping this would make me feel better. When it was time to leave, I told my daughter to grab her sweater it was time to go. The funeral home was about 35 minutes away from our house. As we got closer to arriving, I remember looking at my phone to see which way I was to turn ... the next thing I remember is leaving jail. I slightly remember hearing my daughter yelling at me yet I couldn't make out what she was saying. From what the report said, the police followed me and pulled me over after I parked in the church parking lot. He asked me how much I had to drink, I replied nothing. He asked me why my eyes were blood shot red and watery, I told him I was here for my nephews funeral. The police stated in his report that I was unable to follow directions and slurring my words. Why weren't the paramedics called? My main concern in this matter, is that nine days later, I was hospitalized for brain trauma due to the fact I had not received medical attention from the arresting officers. The lack of medical attention could have caused unconsciousness, coma or even death. Needless to say, after passing two breathalyzers, I was never able to pay my respects to my family or my nephew. I was hand cuffed in front of my family at the funeral home and taken to custody after they took a picture of my daughter. After reading the report, they also took blood from me which only showed the medications I am legally prescribed to take for my disabilities. My license was suspended by my Neurologist for three months due to my seizures. Eight months after this happened, I receive a letter in the mail stating the courts have suspended my license for three months while under investigation. I have since been charged with Aggravated DUI.
I Danielle Marie Alcocer, am challenging the charges alleged against me in this matter CR2013-430037-001 for several reasons, yet most importantly the discrimination I have faced over the past few years, my rights being violated along with the suicide letter from my than twelve year old daughter dealing with the struggles of our family and now the courts. I have been a single mother for the past thirteen years and have been legally disabled since 2004. I am disabled in a few areas from mental to physical and am requesting the same treatment any disabled person would receive in the STATE OF ARIZONA under the Americans with Disability Act of 1990 (ADA). I would like to mention again this is a medical condition NOT a criminal act. I am aware this is a malicious prosecution, as my rights have been violated, due to discrimination, double jeopardy, and several other violations committed against me and my daughter. As a reminder to the public, due to this discrimination, mental instability/disability, emotional and financial distress, loss of a loved one, my Father's cancer, and lies from my Mother has caused my daughter and I both to suffer from the following:
1. Mental Anguish
2. Time away from Family
3. Financial Stress/ Bind
4. Misuse of Court
5. Misuse of Time
6. Slander of Character
7. Mail Fraud
8. Abuse of Process
9. Emotional Damage
10. Stress on Family
11. Time away from Daughter
12. Medical Suffering Intensified
13. Due Process
14. Anxiety
15. Loss of Sleep
16. Weight Loss (98lbs)
17. Medications changed several times to try and accommodate my mental stability
18. Was FORCED to take fingerprints a year and half later after incident occurred or was THREATED to be placed in prison.
19. Abuse of process harassment
20. Suffered more frequent migraines
21. Suffered more frequent seizures
22. Daughter suffered mental anguish
23. Was unable to be self sufficient
24. Unable to do normal daily activities
25. Had to have a driver for three months while my Neurologist did testing
26. Had to have a driver for three months while state was researching (punished twice for a medical condition, and second for the STATE to research
27. Had to pay $300-$500 every month or other month for court travel cost
28. Paid to get vehicle out of impound yard
29. Daughter wrote suicide letter as she was afraid of losing her mother due to my illness and being bullied for it
30. Daughter was kicked out of school and placed online
31. Missed two year old nephews funeral
32. Payment for processing of paperwork
33. Felt sexually violated by peace officers and the comments made
34. 4th and 5th Amendment rights were violated.

I would also like to briefly mention, that if in fact I was under the influence as alleged by peace officer, and unable to drive or operate heavy machinery, why was I released two hours after I was brought into custody. I was never booked, nor fingerprinted. Wouldn’t this be a danger to me and the public? I was given permission to retrieve my vehicle at the police impound. Still unaware of what was happening as I was still in an unstable condition.
I attain a medical marijuana prescription for several reasons one of having chronic pain, fibromyalgia and severe migraines. I have tried almost all medications on the market; this is THE ONLY MEDICATION that works for me and my conditions. It also helps me to eat, sleep as I suffer from insomnia, get my manic episodes stabilized and the list goes on and on. I have been prescribed the medication by a practicing physician under the AZ STATE laws for a medical condition in which prescription medication does not help. Under the AZ law 28-1381 (A); paragraph 1 this section that the person is or has been entitled to use the drug under the laws of the state. D. A person using a drug as prescribed by medical practitioner licensed pursuant to title 32 chapter 7, 11, 12 or 17 is NOT guilty of violating subjection A. As my practitioner is licensed and practicing legally in the state of AZ.
I feel I am having to fight for my rights alone, as I have had two public defenders in a course of two years, of which they both only appeared in court once. Meanwhile I am spending thousands of dollars in travel expenses to appear in court, only to find I'm the only one there and another continuance has been made. I am a Woman of the Lord, not a person, as I have made a covenant with the Lord to serve Him all the rest of my days and for eternity, as He is my Lawyer, my Judge, my Prosecutor … I leave my life in the hands of Our Lord Yahweh!
